This video is a portion of a video-taped testimony from a long term disability insurance claim denial lawsuit. The actual testimony in this video was presented to a jury in federal court. The jury awarded long term disability insurance benefits to our client. The deposition was completed on behalf of our client by attorney Gregory Michael Dell. While watching this video, you can judge the credibility of this disability insurance company employee by watching her listening to her responses. While this video is public record we ar enot revealing the identity of this insurance company employee. This disability benefits employee, was a disability claims manager and she was the claims examiner responsible for making the final decision to deny long term disability benefits to our client, a board certified general surgeon. As the individual with the final authority to approve or deny disability benefits, it is hard to imagine that she did not know the basic requirements of our client’s occupation as a general surgeon. This disability insurance claims manager came to the conclusion that our client could perform all of his material duties as a surgeon, despite the fact that she had no idea how he performed any of his surgeries. It is hard to imagine that she actually testified that she does not know if a gall bladder removal requires the cutting of the skin. The gall bladder is a human organ.
